This End-User Licence Agreement (the “Agreement”) applies to the Bon Dossier application, including its related updates, extensions, documentation and features (the “App”), provided by Rose Development (the “Licensor”, “we”, “us” or “our”).

By downloading, installing or using the App, you accept this Agreement. If you do not agree, you must not use the App. Mandatory statutory rights, including consumer rights in the European Union, always continue to apply.

Parties and relationship with Apple

This Agreement is concluded solely between you and Rose Development, not with Apple. Rose Development is solely responsible for the App and its content, subject to any responsibilities that Apple has towards you under mandatory law or Apple’s own terms.

The usage rules in this Agreement are not intended to conflict with the Apple Media Services Terms and Conditions or any other applicable App Store Usage Rules. In the event of an unintended conflict, applicable mandatory rules and valid App Store Usage Rules will prevail.

Licence model and price

Bon Dossier is licensed, not sold. The current release is offered as a one-time App Store purchase and contains no subscription or in-app purchase. Price, taxes, billing, payment and any refund are handled through Apple under the applicable App Store terms. Rose Development may offer a different price or licence for future, separate products, major new versions or additional services, but will not retrospectively convert an existing purchase into a subscription.

Following a valid acquisition, Rose Development grants you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App:

  • on Apple-branded products that you own or control;
  • for personal use or internal use within your own business or organisation;
  • in accordance with this Agreement and the App Store Usage Rules;
  • by other accounts associated with the purchaser through Family Sharing or volume purchasing, to the extent permitted by Apple’s rules.

The licence does not transfer any ownership interest in the App. Updates that replace or supplement the existing App are governed by this Agreement unless an update is expressly accompanied by a different valid licence.

Permitted use

You may use Bon Dossier to scan, import, store, recognise, review, correct, organise, search, export, back up and manage receipts and similar proof-of-purchase documents. You may use the App for your own records and for internal business purposes.

You may create reasonable backup copies of user data exported by the App. To the extent technically and legally permitted, you may use the App with Apple features such as iCloud, CloudKit, Spotlight, Files, the sharing facility and local notifications.

Prohibited use

Except to the extent expressly permitted by mandatory law, an applicable open-source licence or Rose Development’s written permission, you must not:

  • copy, modify, translate, decompile, disassemble or reverse-engineer the App or any part of it, or use it to derive source code, models or training material;
  • create derivative works of the App or circumvent technical protection measures;
  • rent, lease, sell, sublicense, redistribute or make the App available to third parties as a standalone service;
  • use the App or its output for unlawful, misleading, fraudulent or infringing purposes;
  • interfere with the operation, integrity, availability or security of the App, Apple services or third-party systems;
  • process malware, harmful code or content for which you do not hold the necessary rights through the App;
  • remove or conceal trade marks, copyright notices or other proprietary notices.

Any statutory right to conduct interoperability research, security research, decompilation or reverse engineering is not excluded, but may be exercised only within the applicable legal conditions and limits.

Ownership and intellectual property

All rights, title and interest in the App remain with Rose Development or its licensors. To the extent protected, this includes source and object code, designs, interfaces, text, documentation, database structures, recognition logic, local models, images, trade names and other intellectual property rights.

You retain all rights that you hold in receipts, scans, notes, corrections, categories, exports and other content that you place in or create with the App (“User Content”). You do not grant Rose Development any general ownership or model-training right in User Content. To the extent technically necessary to perform a feature selected by you, you authorise only local processing and processing through the Apple service you use, such as private iCloud sync.

User Content and third-party rights

You are responsible for the User Content that you scan, import, store, export or share. You represent that you have sufficient rights or another valid legal basis for doing so and that you respect the privacy, confidentiality, intellectual property and other rights of third parties.

Do not store documents relating to other people in the App where doing so would be unlawful. Share exports or backups only with authorised recipients and apply appropriate security to business or sensitive information.

Not an accounting, tax or legal system

Bon Dossier is a tool for storing, organising and retrieving receipts. The App is not accounting software, an accounting firm, a tax advisory tool, legal advice, a financial control system or a guaranteed evidence archive.

The App does not replace professional accounting, tax advice, annual-accounts software, an audit process, statutory record-keeping obligations or any obligation to retain original evidence. You remain responsible for, among other things:

  • checking receipts, amounts, dates, VAT and line items;
  • retaining original evidence for the required period where required by law or contract;
  • tax and VAT returns, expense claims and business records;
  • deciding whether a scan, export or recognised value is suitable for a return, warranty claim, accounting, tax or legal purpose;
  • consulting an accountant, auditor, tax adviser, lawyer or other professional when appropriate.

OCR, recognition and accuracy

Bon Dossier uses OCR, image recognition, local machine-learning models and other automated techniques. Recognition is probabilistic. We do not guarantee that OCR text, categorisation, merchant names, addresses, amounts, dates, VAT entries, payment methods, line items, return deadlines, warranty dates, totals, insights or exports will be complete or error-free.

Creases, fading, thermal paper, reflections, shadows, skewed or cropped photographs, unusual receipt layouts, languages, currencies and other circumstances may affect results. Always review important information before relying on it.

Storage, iCloud, backup and data loss

Bon Dossier stores data locally. When iCloud sync is available and enabled, receipt data and original scans may be synchronised between your devices through the private iCloud database associated with your Apple Account. Apple’s terms and privacy policy also apply to iCloud and other Apple services.

For a normal first installation, iCloud sync is enabled by default and can be turned off in Bon Dossier’s settings. A change becomes active after the App is restarted. Disabling sync does not automatically delete existing iCloud copies.

Backup, restore, export and sharing are assistance features. You are responsible for creating and checking backups, securing exports, maintaining sufficient iCloud and device storage, and retaining important original documents. Depending on sync, backups and external storage locations, Rose Development may be unable to restore deleted data.

Privacy

The Bon Dossier Privacy Policy applies to the processing of personal data through the App. The current version must be made available through the App Store listing, the App and Rose Development’s website.

Receipt recognition takes place locally on the device. Bon Dossier uses no advertising, tracking, third-party analytics, or external OCR or AI services. Details about local storage, iCloud, permissions, retention, deletion and privacy rights are set out in the Privacy Policy.

Maintenance, support and updates

Rose Development is solely responsible for providing maintenance and support to the extent promised or required under this Agreement, the App Store listing or applicable law. Apple has no obligation whatsoever to provide maintenance or support services for Bon Dossier.

Rose Development may release updates, security fixes, bug fixes, compatibility changes and improvements. We do not guarantee that every feature or compatibility will remain available indefinitely. Statutory consumer rights relating to conformity, necessary updates and remedies remain fully applicable. Failure to install a clearly offered necessary update in time may affect a defect caused solely by the absence of that update, but only where permitted by law and where the installation instructions were adequate.

Conformity and warranties

Bon Dossier is provided as available, subject to all mandatory statutory warranties and conformity rights. Nothing in this Agreement limits rights that cannot lawfully be excluded, including consumer rights to digital content or a digital service that conforms to the contract.

To the extent permitted by law, Rose Development gives no additional warranty that the App will always be uninterrupted, error-free, completely secure or suitable for every particular purpose, or that recognition results will always be accurate.

If the App fails to conform to an applicable warranty, you may notify Apple. Apple will refund the purchase price for the App to you in accordance with the applicable App Store terms. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App. Rose Development remains responsible for any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty or conformity obligation owed by Rose Development.

Product claims

Rose Development, not Apple, is solely responsible for addressing claims by you or a third party relating to the App or your possession or use of it, including:

  • product-liability claims;
  • claims that the App fails to conform to an applicable legal or regulatory requirement;
  • claims arising under consumer-protection, privacy or similar legislation.

This allocation does not limit any rights you may have directly against Apple or another party under mandatory law or your own agreement with that party.

Intellectual-property claims

If a third party claims that the App, or your permitted possession and use of it, infringes that third party’s intellectual property rights, Rose Development—not Apple—will be solely responsible for the investigation, defence, settlement and discharge of that claim, to the extent the claim concerns the App supplied by Rose Development.

This responsibility does not apply to a claim arising from your User Content, an unauthorised modification, a combination not supplied by Rose Development, or use in breach of this Agreement.

Liability

Nothing in this Agreement limits or excludes liability to the extent that applicable law does not permit it, including liability for intentional misconduct or deliberate recklessness, death or personal injury caused by culpable conduct, breach of mandatory consumer rights, or any other liability that cannot lawfully be limited.

For consumers, Rose Development’s liability is governed by applicable mandatory law. Any limitation in this Agreement applies only to the extent that it is valid against the relevant consumer.

For users acting in the course of a trade, business or profession, Rose Development will not, to the extent permitted by law, be liable for indirect or consequential loss, including loss of profit or revenue, loss of anticipated savings, data loss, loss of evidence, tax or administrative consequences, missed return deadlines or unsuccessful warranty claims. Rose Development’s total liability to a business user is, to the extent permitted by law, limited to the amount that user paid for the App during the twelve months preceding the event giving rise to the loss. This limitation does not apply where the loss results from Rose Development’s intentional misconduct or deliberate recklessness, or where the law prohibits the limitation.

You must take reasonable measures to prevent or mitigate loss, including reviewing recognition results, exporting or backing up important data in time, and retaining original evidence where necessary.

Legal compliance, export controls and sanctions

You must not use, export or re-export the App in breach of applicable export laws, sanctions or trade restrictions.

To the extent required for distribution through Apple, you represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.

You are also responsible for complying with applicable local laws when using, storing and sharing documents and personal data.

Third-party terms

When using Bon Dossier, you must comply with applicable third-party terms. Where relevant, these include the Apple Media Services Terms and Conditions, App Store Usage Rules, Apple Account and iCloud terms, your network provider’s terms, and the terms of any storage, sharing or export service selected by you.

Rose Development is not responsible for the content, availability or terms of a third-party service selected by you, except to the extent mandatory law provides otherwise.

Termination

The licence continues until lawfully terminated by you or Rose Development. You may terminate this Agreement by ceasing use and deleting the App, while separately managing any exports, backups and iCloud data that you have stored.

Rose Development may terminate the licence for a material breach of this Agreement. Where the breach is capable of remedy, we will first provide a reasonable opportunity to remedy it. The licence may terminate immediately where continued use is unlawful, presents a serious security threat or cannot reasonably be remedied.

Following termination, you must cease using the App and delete it where reasonably applicable. Provisions concerning ownership, User Content, liability, governing law and provisions that by their nature survive will remain in effect. Termination does not affect accrued rights or mandatory consumer rights.

Changes to this Agreement

Rose Development may amend this Agreement because of changes to the App, applicable law, security requirements or distribution terms. A new version will not apply retrospectively to the user’s detriment.

Where a change is material, clear advance notice will be provided through the App, App Store listing or website where appropriate. If a change requires consent, we will request that consent. If you do not accept a material change that is not required for legal or security reasons, you may discontinue use. Mandatory rights and accrued claims remain unaffected.

Governing law and disputes

This Agreement is governed by Dutch law. If you are a consumer, you retain the protection of mandatory provisions of the law of the EU or EEA country in which you habitually reside where that law grants such protection. A consumer may bring a dispute before any court competent under applicable law, including, where applicable, the courts of the consumer’s place of residence.

Please contact Rose Development before escalating a complaint. This does not restrict your right to approach a competent supervisory authority, dispute-resolution body or court.

Apple as third-party beneficiary

Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance, Apple will have the right—and will be deemed to have accepted the right—to enforce this Agreement against you as a third-party beneficiary.

General provisions

If any provision is wholly or partly invalid or unenforceable, the remaining provisions will continue in effect. To the extent legally possible, the invalid provision will be replaced or interpreted in a way that most closely achieves its purpose without limiting mandatory rights.

A failure to enforce a right immediately is not a waiver of that right. You may not assign this Agreement or licence except to the extent permitted by the App Store Usage Rules or mandatory law. Rose Development may transfer its rights and obligations provided that doing so does not reduce consumers’ mandatory rights.

This Agreement, the Privacy Policy and the applicable App Store terms together constitute the arrangements governing use of the App, each for its own subject matter. In the event of a conflict, mandatory law and non-excludable consumer rights prevail.
